Here is the revised and localized End User License Agreement (EULA) and Terms of Service, rewritten specifically for NGo Cabs and IXA Global, operating under Indian law.

This application, NGo Cabs, is licensed to You (End-User) by IXA Global (hereinafter: Licensor), headquartered in Agartala, Tripura, India, for use only under the terms of this License Agreement.
By downloading the Application from the Apple App Store or Google Play Store, and any update thereto (as permitted by this License Agreement), You indicate that You agree to be bound by all of the terms and conditions of this License Agreement.
The parties of this License Agreement acknowledge that Apple and/or Google Play are not Parties to this License Agreement and are not bound by any provisions or obligations with regard to the Application, such as warranty, liability, maintenance, and support thereof. IXA Global, not Apple or Google Play, is solely responsible for the licensed Application and its content.
This License Agreement may not provide usage rules for the Application that conflict with the latest App Store or Play Store Terms of Service. IXA Global acknowledges that it has reviewed said terms and this License Agreement does not conflict with them.
All rights not expressly granted to You are reserved.
NGo Cabs (hereinafter: Application) is a software platform designed for Ride-Hailing services—customized for Apple and Android mobile devices. It connects riders to driver partners to facilitate transportation at the push of a button.
You may not use the Application in any manner that violates the Information Technology Act, 2000 of India, the Digital Personal Data Protection Act, 2023, or any other applicable local or national laws.
2.1 You are granted a non-transferable, non-exclusive, non-sublicensable license to install and use the Licensed Application on any Apple-branded or Android device that You (End-User) own or control. 2.2 This license governs any updates of the Application provided by the Licensor that replace, repair, and/or supplement the original Application, unless a separate license is provided for such an update. 2.3 You may not share or make the Application available to third parties, sell, rent, lend, lease, or otherwise redistribute the Application. 2.4 You may not reverse engineer, translate, disassemble, integrate, decompile, remove, modify, combine, create derivative works or updates of, adapt, or attempt to derive the source code of the Application (except with IXA Global's prior written consent). 2.5 You may not alter the Application or portions thereof. You may not remove any intellectual property notices. 2.6 Violations of the obligations mentioned above may be subject to prosecution and damages under Indian copyright and technology laws. 2.7 The Licensor reserves the right to modify the terms and conditions of licensing at any time.
3.1 The Licensor attempts to keep the Application updated to comply with modified/new versions of firmware and hardware. You are not granted rights to claim or demand such updates. 3.2 It is Your responsibility to ensure the device on which You intend to use the Application satisfies the necessary technical specifications (such as minimum Android/iOS versions and active GPS functionality).
4.1 The Licensor is solely responsible for providing any maintenance and support services for this licensed Application. You can reach the Licensor via the contact details provided below. 4.2 IXA Global and the End-User acknowledge that Apple and Google Play have no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
You acknowledge that the Licensor will collect, process, and store Your personal data (such as location and contact info) to facilitate the ride-hailing service. The use of such material and information is strictly subject to the NGo Cabs Privacy Policy.
The Application may allow you to provide ratings, feedback, or communicate with drivers (collectively, "Contributions"). When you make Contributions or use the app, you agree that:
Your Contributions are not false, inaccurate, or misleading.
Your Contributions are not obscene, violent, harassing, libelous, slanderous, or otherwise objectionable.
Your Contributions do not threaten any person or promote violence.
You will not use the Application to solicit personal information from minors.
Your Contributions do not violate the privacy rights of any third party.
Your Contributions do not violate any applicable Indian laws or regulations.
Any use of the Application in violation of the foregoing may result in immediate termination or suspension of your account.
7.1 IXA Global acts solely as a technology platform connecting riders with independent driver partners. IXA Global's liability for damages caused by a breach of its own platform duties is limited to intent and gross negligence. The limitation does not apply to injuries to life, limb, or health caused directly by the Licensor's gross negligence. 7.2 IXA Global takes no accountability or responsibility for damages caused by the actions of third-party driver partners, traffic delays, or network failures.
8.1 The Licensor warrants that the Application is free of malware at the time of Your download. 8.2 No warranty is provided for an Application that has been modified without authorization, used on a jailbroken/rooted device, or affected by issues outside of IXA Global's sphere of influence (such as poor cellular network). 8.3 In the event of any failure of the Application to conform to any applicable warranty, You may notify the App Store Operator, and your Application purchase price (if any) will be refunded. Apple/Google will have no other warranty obligations.
IXA Global, and not Apple or Google, is responsible for addressing any claims relating to the Application, including: (i) product liability claims; (ii) claims that the Application fails to conform to any legal or regulatory requirement; and (iii) claims arising under consumer protection legislation in India.
You represent and warrant that You are not located in a country that is subject to an embargo by the Government of India, and that You are not listed on any Government of India list of prohibited or restricted parties.

The license is valid until terminated by IXA Global or by You. Your rights under this license will terminate automatically and without notice if You fail to adhere to any term(s) of this license. Upon termination, You shall stop all use of the Application and delete it from your device.
IXA Global will comply with applicable third-party terms of agreement when using the licensed Application (e.g., Google Maps API terms). Apple and Apple's subsidiaries are third-party beneficiaries of this EULA. Upon Your acceptance of this license agreement, Apple will have the right to enforce this EULA against You as a third-party beneficiary.
In the event of any third-party claim that the Application or Your possession and use of it infringes on that third party's intellectual property rights, IXA Global, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
This license agreement is governed by the laws of the Republic of India. Any disputes arising from this agreement or the use of the Application shall be subject to the exclusive jurisdiction of the competent courts in Agartala, Tripura.
If any of the terms of this agreement become invalid, the validity of the remaining provisions shall not be affected. Invalid terms will be replaced by valid ones formulated to achieve the primary legal purpose.
